Is it necessary to appear in Family Court when I file for divorce?

It is normally not required that you appear in Family Court to obtain a divorce. The standard procedure is the Family Court can deal with your divorce on the papers alone.

You can file for an individual application or a joint one. In either case there are Family Court filing fees to be paid.

In general, Legal Aid is not available for a divorce.

If there is a dispute about the date you were living apart or separated, then you may need to go to Family Court to argue that point.

In general we advise clients to wait between 3 and 6 months from when they first get the paperwork together until the divorce has been made.
