Shared Care Parenting - Deciding on a School

Question:

My ex-partner and I share care of our four year old daughter. She turns five at the end of this year and my ex and I cannot agree on a school for her. I recently found out that my ex went ahead and enrolled her at a school in my ex’s neighbourhood without any discussion with me. Can she do this?

Answer:

What school a child goes to is a guardianship decision which ultimately means that both parents must be consulted before any decisions are made. Just because your daughter is enrolled at the school does not mean that she has to attend. There are a number of options that you can take to resolve this issue however I would recommend raising the issue with your ex first. It may be that she is unaware of the legal position, or that she is simply wanting to reserve a place at the school for your daughter should she end up attending. If the two of you are unable to resolve the issue between yourselves, come and see us and we can discuss the options available to you.
