Under the Family Protection Act, a family member can challenge a will on the grounds that they were not adequately provided for in the will.

We assist clients in family protection claims and proceedings, both in negotiations and in Court.

We deal with testamentary promises, deeds of arrangement, issues around invalid wills and wills in relation to the Property Relationships Act.

Frequently Asked Questions

How do I change lawyers when I am legally aided?

If you have concerns about your current lawyer, we would encourage you to speak with them first directly, as the issues may be able to be resolved. If this is not possible, you should contact the Ministry of Justice (Legal Services) and advise that you wish to instruct a different lawyer. Once they have approved this, you can then look at finding a new lawyer. Once you have instructed a new lawyer, they will take care of the rest for you.

Can I force my ex to pay half of the mortgage payments?

If you are struggling to make these payments, you may want to consider asking your bank to pay interest only while you resolve relationship property matters. There are consequences for this, obviously, but you can talk these through with your bank. It may also help to draw up a budget of your income and outgoings when looking at matters going forward. We would be happy to meet with you and discuss all of these issues further.
